QuartileBI provides its digital products (Power BI Template Apps) and services on an "as-is" basis, without any express or implied warranties, including warranties of merchantability or fitness for a particular purpose. While we strive to ensure the quality and performance of our digital products (Power BI Template Apps) and services, we cannot guarantee their functionality in all scenarios due to variations in user data and environments. You acknowledge that using Power BI Template Apps from QuartileBI is at your own risk, and QuartileBI is not responsible for any damages, including but not limited to lost profits, data loss, or business interruptions resulting from their use.

 

3. Indemnification

You agree to indemnify and hold QuartileBI, its directors, officers, employees, affiliates, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Site or violation of these Terms. This indemnification applies to claims resulting from both negligent and intentional acts.

4. Data Protection and Privacy

QuartileBI takes the privacy of its users seriously and complies with relevant data protection regulations, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the Australian Privacy Principles (APPs). 5. Digital Product Agreement

This Digital Product Agreement (“Agreement”) is entered into between QuartileBI (the “Company”) and the purchaser of digital products (i.e., Power BI Template Apps) (“Client”). By submitting payment and downloading the PBIX file associated with a Power BI Template App, the Client agrees to the terms outlined below:

 

- After purchasing the digital product, the Client will receive access to the PBIX file via the website portal OR email OR a download link. OR as decided verbally. 

- The Client agrees not to share the PBIX file with third parties or host it on any portals for free distribution.

 

6. Fees & Payment Processing

All transactions on the QuartileBI website are processed through secure payment gateways with SSL encryption. QuartileBI complies with PCI DSS (Payment Card Industry Data Security Standards), ensuring safe and secure payments. Payment details are not stored during the transaction process.

7. Payment Terms for Digital Products and Services

Services: The Client will pay QuartileBI a fee as agreed upon. A minimum of 50% of the overall fee is due upon receipt of the invoice and before the service begins. The remaining balance is due upon completion of the service or project.

Digital Products: The Client agrees to pay the fee listed on the QuartileBI portal for Power BI Template Apps. If a payment method is declined, the Client must provide a valid payment method before receiving access to the product. If access to the product has already been provided, QuartileBI reserves the right to recover outstanding payments.

 

8. Refund Policy for Digital Products

Due to the nature of digital products, Power BI Template Apps from QuartileBI are not eligible for refunds after purchase.

 

9. Governing Law and Jurisdiction

This Agreement is governed by and construed under the laws of India. Any disputes arising from this Agreement are subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

 

10. Confidentiality

QuartileBI will treat all proprietary information shared by the Client as strictly confidential. QuartileBI will not use, disclose, or communicate such information without prior consent, except as required for service delivery.

 

11. Support Terms

QuartileBI provides limited support for digital products. Support includes addressing issues related to product functionality or resolving technical issues encountered during the initial setup. Support does not cover customizations, enhancements, or issues caused by modifications to the product. Support requests can be submitted via email at info@quartilebi.com.

 

12. Limitations of Use

The digital products (Power BI Template Apps) provided by QuartileBI are for personal or organizational use only. They may not be resold, sublicensed, or used to create derivative works intended for distribution. Violating these terms will result in immediate termination of the license and potential legal action.

 

13. Modifications to Terms

QuartileBI reserves the right to update or modify these Terms at any time. Any changes will be posted on this page, and users may be notified via email or a prominent notice on the Site. Continued use of the Site constitutes acceptance of the revised Terms.
